Course Description

In recent years, primarily due to the exploding property prices, there has been a palatable uptick in disputes involving estates in the Hong Kong Courts.  However, the amalgamation of traditional Chinese values, unwillingness to deal with assets of deceased, lack of understanding of how the probate and administration regime works and general unawareness of the extent of the duties and responsibilities placed on personal representatives, many dealing with estates find themselves lost or in trouble.

In this webinar, the speakers will highlight one of the most useful tools in a personal representative’s arsenal; administration action under Order 85 of the Rules of the High Court, Cap. 4A.

An administration action is a procedure by which personal representatives are able to seek guidance from the Probate Court and common applications relating to a deceased’s estate, include determination as to who is entitled to an estate, orders for interim distribution, removal of personal representatives. In addition, personal representatives can also seek sanction to commence or defend an action, or what is more commonly known as Beddoe applications.

This webinar will provide an overview of the common applications made in an administrative action, deal with the procedure and touch upon the substantive law.  In particular, the speakers will also shed light on the Beddoe application procedure and deal with matters that practitioners should watch out when seeking sanction from the Probate Courts.
