LexisNexis Dispute Resolution CPD Course: Litigation and Arbitration: Funding and Interim Relief

Course Outline

Part I: Third Party Funding in Litigation and Arbitration (1 hour)
This part of the seminar will discuss recent cases in which the Hong Kong Court considered whether third party funding is permitted in litigation.
The speaker will also introduce the new amendments to the Arbitration Ordinance (Cap 609) which allow third party funding in arbitration and the relevant safeguards in place.

Part II: Injunction in aid of Foreign Litigation and Arbitration (2 hours)
This part of the seminar focuses on interim injunction granted by the Hong Kong Court in aid of Foreign Litigation and Arbitration. The speaker will discuss the tests for obtaining such injunction and recent cases in this area. The speaker will also briefly talk about the "Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the HKSAR" which enables the PRC Courts to grant interim injunction in aid of Hong Kong arbitrations.
