The newly released NEC4 contracts introduces two new concepts; ‘Dispute Avoidance Boards’ and a period for escalation and negotiation, in terms of dispute resolution. The NEC4 philosophy places importance on the parties’ shared behavior and active engagement in resolving issues before the need for a formal dispute resolution – and this is clearly reflected in the sections title change from “Dispute Resolution” to “Resolving and Avoiding Disputes.”
