Personal data must not, without voluntary consent of a data subject, be used for a purpose that differs from the intended purpose for which the data was collected. The term 'use' includes transfer.

Recently, an employment agency transferred the complainant's personal data to a third party without the complainant's consent. Its director was the first offender convicted of failing to comply with a lawful requirement of the Privacy Commissioner. The director pleaded guilty and was fined HK$3,000.
