Recently, Hong Kong's outgoing development minister said the challenge of his successor would be holding landlords of illegal cubicle flats criminally accountable. Currently, it is not against the law for a tenant to sublet to a subtenant in contravention of a covenant in the head lease between the tenant and the landlord. However, the subletting would be unauthorized and will expose both the tenant and subtenant to the risk of possession proceedings by the landlord.
