His Honour Judge Simon Brown QC

His Honour Judge Simon Brown QC is a Designated Mercantile Judge assigned to the Birmingham Civil Justice Centre. The BCJC is a sophisticated and efficient place by virtue equally of its facilities and its people.

Judge Brown is committed to cost-effective and efficient case management, both in his own court and outside it, and in particularly as to the importance of electronic disclosure. He has been involved in the e-Disclosure Project being undertaken by Chris Dale of Chris Dales Associate. Over the past two years, he has addressed audiences ranging from fellow English judges to a New York conference where he discussed with US Federal judges the similarities and the differences between US and UK principles and practice. He has recently participated in the renowned international Sedona Conference in Barcelona. He is currently assisting with the areas of Electronic Disclosure and Costs Management in business cases in the major review of litigation costs in UK by Lord Justice Jackson. His draft directions order, which leaves no room for avoiding key management points such as a list of issues and compliance with the CPR obligations as to disclosure and proportionality, is in use in all the Mercantile Courts.

His responsibilities include supervising the forensic workflow process and ensuring that digital evidence is acquired and examined in accordance with established best practice and legal requirements.

 

Roger Clay
Associate Director,
Ernst & Young

Roger is an Associate Director with Ernst & Young and leads their Forensic Technology & Discovery Services team in the ASEAN area.

He has been involved in the field of forensic technology for over 10 years with experience in electronic discovery, computer forensics and electronic investigations. Prior to joining the Singapore practice, Roger worked with the Ernst & Young Australia where he led the Oceania forensic technology team.

Roger has performed forensic engagements on behalf of Ernst & Young for a number of major clients including large corporations, educational institutions and government departments. This includes assignments on behalf of a number of key national and international clients. Roger has coordinated forensic services throughout Australia, Hong Kong, China, Japan, United Kingdom, Korea and Japan. Roger has written a number of articles on computer forensics and recently co-authored an Electronic Discovery Primer which was published in the Singapore Law Gazette, March 2009.

He is a Certified Encase Examiner, Certified Computer Examiner and Certified Attenex Patterns Trainer.

Roger holds a Master of eForensics & Enterprise Security, Graduate Certificate in eCrime Investigation and a Bachelor of Management Information Systems. He is currently completing a Master of Business Administration.


Dr. K.P. Chow
Associate Professor of Department of Computer Science,
The University of Hong Kong

Dr. K. P. Chow is the Associate Professor of Department of Computer Science and the Associate Director of the Center for Information Security and Cryptography at The University of Hong Kong.  Dr. Chow’s areas of research interest are computer forensics and computer security.  He was the chief designer of the computer forensic tool Digital Evidence Search Kit (DESK).  Dr. Chow has been working on the Internet piracy monitoring system Lineament, which is adopted by HKSAR Customs and Excise Department in 2007.  He has also published research papers on computer forensics and computer security in local and international conferences and journals.  Dr. Chow has been a member of the Program Committee of the international computer forensic workshop SADFE.  He is the conference chairman of the Sixth IFIP WG 11.9 International Conference on Digital Forensics to be held in 2010 in Hong Kong.  From 2008, Dr. Chow is the Vice Chairman of the Information Security and Forensics Society (ISFS).  Dr. Chow is also a committee member of the IT Division, Hong Kong Institutions of Engineers, and a council member of the Hong Kong Forensics Science Society.   In the past few years, Dr. Chow has been invited to be a computer forensic expert to assist the Court and the HK law enforcement agencies, and to give advice to counsels on understanding and interpreting digital evidence for both criminal and civil proceedings in Hong Kong.

 

Torsten Duwenhorst

Torsten Duwenhorst is an Associate Director in Ernst & Young’s Fraud Investigation & Dispute Services. He leads the Forensic Technology & Discovery Services group in the Far East Area, covering 17 countries.

He has worked in the fraud mitigation industry in Greater China for the last ten years and was previously based in Beijing and Shanghai.

Torsten has extensive computer forensic incident response experience, executed under discreet and overt circumstances, in Africa, India and the Asia Pacific region, including mainland China, Hong Kong, Taiwan, Japan, South Korea, Singapore, Vietnam, Malaysia and Australia.

Torsten provides computer forensic, e-discovery and forensic data analytics services to Fortune 500 clients with a focus on investigation and litigation support.

Additionally, Torsten works with multinational law firms, advising and providing them with electronic discovery solutions for regional and global projects.

Torsten’s technological skills include an array of computer forensic tools including EnCase amongst others. He is a certified Attenex Patterns Trainer.

Torsten is a member of the Sedona Conference Working Group 6: International Electronic Information Management, Discovery and Disclosure and a member of the HTCIA (High Tech Crime Investigation Association) Asia chapter.

 

Menachem Hasofer

Mr. Hasofer’s main practices focus on litigation, arbitration and mediation, with an emphasis on disputes arising from building construction, engineering and infrastructure projects; experienced in handling document-intensive cases.

Besides advising companies on records retention and management, including storage and retrieval of electronically stored information and e-discovery, Menachem also advise clients on construction insurance claims and contractor insolvency as well as represents applicants in real estate related judicial review.

Menachem has represented land owners and NGOs in judicial review proceedings concerning town planning and land lease decisions, involved in the legal proceedings arising from non conforming foundations at Tin Shui Wai for Hong Kong Housing Authority as well as the ancillary proceedings in Hong Kong and Germany concerning insolvency and global liability insurance. He also acted for the Hong Kong Government in arbitration with joint venture of European/Asian contractors involving questions of Mainland PRC law and for a German drilling contractor in disputes arising from horizontal directional drilling works.

Browning Merean

Browning E. Marean is Snior Counsel in DLA Piper’s San Diego office, and is one of the worldwide leaders of the firm's e-discovery task force.  He advises firm clients about best practices for the preservation of electronic data to avoid litigation risks and to meet the other challenges of e-discovery in a cost effective manner.  He is co-chair of the firm’s Electronic Discovery Readiness and Response Group and is a member of the firm’s Litigation Group. 

 Mr. Marean also specializes in complex business litigation, technology matters, knowledge management and professional responsibility.  He is a frequent and an internationally known teacher and lecturer on various topics including electronic discovery, computer technology, matter management, knowledge management, risk and decision analysis and legal ethics issues.

Mr. Marean joined the firm (then Gray Cary Ames & Frye) in 1969.  He is a member of DLA Piper’s Technology Committee, as well as a member of the Sedona Conference.  He also is on the San Diego County Bar Association Ethics Committee and an emeritus member of the California State Bar Law Practice Management Committee, a member of the ABA Tech Show Board, and the EDRM group.

Mr. Marean is Co-author of “Electronic Discovery and Records Management Guide, Rules, Checklists and Forms” 2009 Edition published by Thomson West, and “Conducting Discovery in an Electronic World: Electronic Data and Discovery” published in California Civil Discovery Practice.

Mr. Marean received his law degree from the University of California, Hastings College of Law and his undergraduate degree from Stanford University.  He is admitted to practice in California and Texas.

 

Scott Nonaka

Scott Nonaka is a partner in the Litigation Department of O'Melveny & Myers LLP and leads the international dispute resolution practice in O'Melveny's Tokyo office.  He is also a member of O'Melveny's Electronic Discovery Group.  Mr. Nonaka litigates and arbitrates a broad range of complex international commercial disputes and regularly represents clients in internal corporate investigations and in connection with Securities and Exchange Commission and Department of Justice investigations.  Before joining O'Melveny, Mr. Nonaka served as an assistant United States attorney in the Northern District of California.

David C. Shonka

David C. Shonka is the Principal Deputy General Counsel of the Federal Trade Commission and he heads the FTC’s E-Discovery Steering Committee.  Until recently he has served as the agency’s Acting General Counsel.  Before becoming the Principal Deputy, he served as the Assistant General Counsel for Litigation at the FTC from 1993.  Before joining the FTC, Mr. Shonka was an associate in a Washington D.C. law firm and a litigator in the Civil Division of the United States Department of Justice.  In his career at the FTC, Mr. Shonka has tried and argued competition and consumer protection cases in the federal district courts; tried cases in administrative proceedings, represented the Commission in numerous appellate cases; and contributed to the government’s briefs in several Supreme Court cases.  He has spoken at numerous E-Discovery conferences, and has been an instructor in deposition, trial, and motion practice courses.  Besides having been an active litigator, Mr. Shonka has advised the Commission on the entire range of legal and policy issues that have come before the Commission; and he has represented the Commission in several international programs.

 

Dr. Yun Zhao

Rongsheng Xu

Professor Xu is the Chairman of China Computer Forensics Research Center. He has intensive experience and knowledge in dealing with cyber security and digital forensics fields. He currently also advises the ministries and commissions under the PRC government on issues related to information security.

Professor Xu received his PhD from the University of California Santa Cruz in the USA.

 

Damien Adams

Richard Kershaw

Richard is a principal in LECG’s legal technology and analytic consulting practice, based in Hong Kong. He has extensive experience managing large-scale investigations in multiple jurisdictions. Recent engagements have included managing collection of digital data in six jurisdictions relating to a fraud investigation, planning and conducting the collection of nearly 10TB of data in line with the US Federal Rules of Civil Procedure for a securities-related litigation, and Foreign Corrupt Practices Act investigations in Japan and Indonesia.

Prior to joining LECG, Richard was head of forensic technology for a security and investigations consultancy, with responsibility for the Asia region. He also served as country manager for Japan for the same firm, overseeing all fraud investigations, reputation and compliance due diligence reporting, and civil litigation investigations, in addition to managing computer forensics engagements. Projects included investigation of collusion among vendors to defraud a high tech company in recycling and disposal, travel expense fraud investigation, fraudulent reporting of medical equipment testing, and the dismissal with cause of the Japan representative of a US apparel company’s Japan subsidiary.

He has spoken on computer forensics issues at organizations ranging from the High Technology Crime Investigation Association (HTCIA), International Bankers Association, Information Systems Security Association, and the Asia Pacific Information Security Summit, and is a lecturer for a UK university MSc course in computer forensics delivered in Hong Kong. He has also written for the Asian Counsel law journal on conducting forensic collections in Asia.

Richard holds undergraduate and masters degrees in history from the University of Oxford and gained a First on the University of London postgraduate Japanese diploma course.
